Terms of Use

1. Introduction

These General Terms and Conditions (hereinafter: GTC) set forth the rights and obligations of Fannica Alta Moda (hereinafter: Service Provider) and the Customer (hereinafter: Customer) who enters into a commercial relationship with the Service Provider through the website, as well as the terms and conditions of website usage and commercial transactions. These GTC apply to all transactions and services conducted through the website referred to in this Section 1.

3. Fundamental Provisions

For matters not regulated by this Policy, and for its interpretation, Hungarian law shall apply, in particular Act V of 2013 on the Civil Code ("Ptk."), Act CVIII of 2001 on Certain Issues of Electronic Commerce Services and Information Society Services, and Government Decree 45/2014 (II.26.) on the detailed rules of contracts between consumers and businesses. The mandatory provisions of applicable laws shall apply to the parties without any special stipulation.

This Policy remains in effect until withdrawn. The Service Provider is entitled to unilaterally modify the Policy, which will be published on the website. By using the website, users accept that all regulations regarding its use automatically apply to them.

By accessing the webshop website operated by the Service Provider or reading its content in any way — even without registration — the User acknowledges the provisions of this Policy as binding. If the User does not accept the conditions, they are not entitled to view the content of the webshop.

The Service Provider reserves all rights related to the webshop website, its elements, and all content displayed on it, including distribution. It is prohibited to download, electronically store, process, or sell any content or part of it from the webshop without the Service Provider's written consent.

4. Registration / Purchase

By registering or making a purchase on the website, the User declares that they have read and accepted these GTC and the Privacy Policy published on the website, and consents to data processing.

During registration or purchase, the User must provide their own real data. If the provided data is false or pertains to another person, the resulting electronic contract is void. The Service Provider excludes liability if a User uses services under another person's name or data.

The Service Provider is not liable for delays in delivery or other issues resulting from inaccurate or incorrect data provided by the User.

The Service Provider is not responsible for damages arising from the User forgetting their password or if, for reasons not attributable to the Service Provider, it becomes accessible to unauthorized persons.

5. Available Products and Services

Products displayed can be ordered online and are available at the B72 Showroom. Prices are shown in HUF (Hungarian Forint), include the legally applicable VAT, but exclude shipping costs. No separate packaging fee is charged.

The webshop provides detailed product names, descriptions, and photos. Images shown on product pages may differ from the actual product and may serve as illustrations. We are not responsible for discrepancies between product images and the actual product.

If a discounted price is introduced, the Service Provider will fully inform Users of the promotion and its exact duration.

If, despite all due diligence, an incorrect price is posted — especially one that is clearly erroneous or significantly deviates from the product's widely known or estimated value, or due to a system error shows as 0 or 1 HUF — the Service Provider is not obliged to fulfill the order at the erroneous price. Instead, it may offer to complete the purchase at the correct price, which the Customer may accept or reject.

In case of a clearly disproportionate price difference, which an average consumer should immediately recognize, no valid contract is established under Act V of 2013 on the Civil Code. Therefore, an order confirmed at an incorrect price is considered null and void.

6. Ordering Process

After registering, the User logs into the webshop or can begin shopping without registration. The User selects the desired product(s) and quantity, adds them to the cart, and may review the cart's contents anytime by clicking the "cart" icon.

The User may continue browsing for additional products. If no more products are needed, they verify quantities and may remove items with the "remove" link. To finalize quantities, the User clicks "update."

The User then selects the shipping address and preferred delivery/payment method.

Payment Methods:

  • Bank Transfer Payment: Users may easily pay online through the secure PayPal system. After the amount is credited to the Service Provider's account, the User may collect the product(s) via the chosen method.

7. Right of Withdrawal

According to Government Decree 45/2014 (II.26.) on contracts concluded remotely, the Buyer may withdraw from the contract without justification within 14 days of receiving the product, or anytime between placing the order and receiving the product. If no notice of the right of withdrawal is provided, the Buyer may exercise this right within 12 months.

The withdrawal period expires 14 days after the Buyer or a third party (not the courier) takes possession of the product.

To exercise the right of withdrawal, the Buyer must submit a clear written statement by email or post. The date of mailing is considered the official notice date. The Service Provider accepts returns sent by post or courier to the following address:

A withdrawal form template may also be printed and submitted.

The Buyer bears no costs except for the return shipping. However, the Service Provider may seek compensation for damage from improper use.

The Buyer must return the goods without undue delay and no later than 14 days after notifying the Service Provider of the withdrawal.

Withdrawal rights do not apply to personalized products or items made to the Buyer's specifications (e.g., made-to-measure clothing).

Upon receiving the returned product, the Service Provider refunds the full amount within 14 days.

Refunds are issued using the same payment method unless the Buyer expressly agrees otherwise. No extra fees are charged for refunds.

Buyers must use products appropriately. Damage from misuse is the Buyer's responsibility. Deductions from the refund may apply in case of depreciation due to improper use.

Refunds will be issued to the Buyer's provided bank account within 14 days of the product's return. The Service Provider may withhold the refund until the product is returned or the Buyer provides proof of return—whichever is earlier.

Withdrawal rights do not apply to businesses, i.e., individuals acting within the scope of their profession or business.

8. Complaint Handling Process

The Service Provider's primary aim is to fulfill all orders to the highest quality and to meet Buyer expectations. In the event of any issues or complaints, the Buyer may contact the Service Provider via email, phone, or postal mail as listed above.

The Service Provider investigates all complaints immediately and resolves them as needed. If the Buyer disagrees with the resolution, the Service Provider records the complaint and its position in a written report, providing a copy to the Buyer.

If immediate investigation is not possible, the Service Provider will still record the complaint and give a copy to the Buyer.

Written complaints will be answered in writing by Fanni Rohonczi E.V. within 30 days, with reasons provided in case of rejection. A copy of the response is retained for 3 years and provided to supervisory authorities upon request.

The European Commission has created an online platform for consumers to register and resolve disputes related to online shopping by submitting a complaint, avoiding court proceedings.
